isn't probable. the hearing has been filled with wild accusations from both sides including police found testosterone and needles in pistorius's bedroom and the lead investigator charged with attempted murder and dismissed from the case and today south africa's most senior detective was assigned to the case. the defense said pistorius is not a flight risk and one of the primary reasons he should be released on bond is his prosthetic legs saying they need to be adjusted every month. if pistorius is not granted bail, his defense team says it will immediately appeal. we're still waiting for this decision to come down in oscar pistorius's bail hearing. it's day four. we expect this decision any minute now. jon, laura? >> thank you very much. it's 5:02. happening now, the manhunt is on this morning for people responsible for the death of an

oakland rapper and two other people on the las vegas strip. las vegas police say people inside a black range rover opened fire on rapper kenneth cherry while driving his maserati around 4:30 yesterday morning. the cab driver and passenger were killed in that cab and four others were injured. cherry's father spoke with "today in the bay" and our own bob redell is live in oakland with that part of the story for us. good morning, bob. >> reporter: good morning to you, laura. his father who lives in oakland tells us that his son, kenny cherry, rapper name kenny clutch, was the sweet of the man he ever met. yesterday kenneth cherry, sr., received the worst kind of news. a phone call from his son's girlfriend that his first born, his 27-year-old boy, had been murdered in las vegas after an argument that started with some people in the parking lot outside of a hotel.

six months ago he appeared in this music video filmed on the vegas strip. he was driving that maserati down the strip when he was shot and killed early yesterday morning. >> i heard there was some kind of disagreement. the guys pulled to the side of him and let the window down. they just started shooting. my son for the record did not have any guns in his car. there was no gun battle. nothing like that. >> reporter: there was at least one person in a black range rover who shot cherry causing his maserati to slam into taxi. that taxi caught fire killing the driver and passenger. a passenger in cherry's car but so far survived. police are on the lookout for the black range rover. he attended several catholic schools including st. mary's in albany. a bright kid when it came to math. his priority right now is to bury his son and help take care

of his three grandchildren including a 2-month-old baby girl. reporting live here in oakland, bob redell, "today in the bay." the woman that tried to shake down wendy's by putting a severed finger in her chili is back in court this morning. arturo santiago has new details of her latest arrest. good morning, arturo. >> reporter: good morning, jon. 47-year-old was just trying to keep her son out of trouble when her story went really heavy on the details just like she did back in 2005 when she lied about the crunchiness of the finger she had beaten into. she's charged with being accessory to a felony and filing a false police report. a detailed descriptions of two nonexistent men who supposedly shot her 26-year-old son in the ankle. she said one of them wore a black oakland a's cap and air jordan shoes and other was a big

man with goatee and large ears. her son shot himself in the ankle but made up the story because he has a burglary conviction on his record and is not supposed to have a gun. their story fell apart under more questioning by detectives and an investigation. so they are scheduled to be arraigned in court at noon today here at the hall of justice. we're live in san jose, i'm arturo santiago, "today in the bay." >> it is 5:06. walnut creek police trying to figure out who stole the personal information of hundreds of mercedes-benz owner. sometime between the night of february 7th and the next morning, someone broke into the dealership and took hundreds of files from a locked area. those files actually contain the names, addresses, social security and credit card numbers of mercedes-benz of walnut creek customers. a rally in support of renaming sfo after harvey milk

opener with giants hosting the angels. when you look at all that's gone into spring training, we've had all kinds of weather for certain. raining and cold and sunny days and field crew has to adjust to everything. take a look. >> each day at sunrise in arizona be it a day marked by rain or shine, the giants have to be ready for whatever is thrown their way even ice in the outfield. the field crew at scottsdale stadium is up for the challenge. >> we do a lot of smoke and mirrors trick to try to get by for this 45-day stretch and when the team breaks, you know, it's back to normalcy. >> the giants field operation manager explains what makes this spring training home so unique. >> so many players on one field. we're not set up like a lot of other complexes that have eight

to ten fields at their mercy. we have 2 to 2 1/2 and minor leaguers are about a mile and a half away where it's really tough to rotate foot traffic. you never know when we'll get an irrigation break or coaches will want to do something early and we're stuck. the goal is to be prepared and pull tarps off and just go. >> reporter: the crew gets an extra spring in their step knowing they are working right alongside the world champs. >> absolutely. throughout the organization it's a job to everybody, sure. it's a lot easier to come to the ballpark when you a winners. it shows amongst the crew and atmosphere and especially when fans get here. it takes it to another level. it makes it a lot easier. >> reporter: they really do a great job. the field looks excellent. almost reminds you of the job that greg elliott back at at&t park and his crew do to make

is pleased with hp this morning because the slowdown isn't as much as investors expected. the team is losing. it's just not losing as badly as people figured. let's turn to courtney reagan on this friday for a check at markets at cnbc world headquarters. good morning, courtney. >> good morning, scott. i want to tell viewers that our david faber will interview meg whitman in an hour from now. futures are higher today after stocks fell for a second straight day. however, we did close the day off the lows at the very least so things weren't as bad as could have been expected. however, we had disappointing data for manufacturing in both europe and the u.s. the dow posted its worst two-day drop of the year. broader s&p index set for its first weekly loss in the past eight weeks. no economic data today. earnings from abercrombie & fitch will steer the markets.

dow fell nearly 47 points and will open trade today at 13,880. nasdaq fell to 3131. futures are higher going into the opening bell. >> we'll watch for that whitman interview. looking ahead to next week, apple holds its shareholders meeting and one shareholder in particular wants your attention. david einhorn held a strategy meeting thursday trying to rally other shareholders into pressuring apple to create a special class of stock which would pay out a permanent dividend. apple has $100 billion or more in cash it's not using. companies resist playing regular dividends because it's a sign the company is not cool anymore. it's not a young startup. a mature company with no major growth ahead of it. if you have 100 billion or more sitting around with no idea what to do with it, that is a sign you're not a growth company any way even if you don't give it back. a couple shots at apple trying

mild conditions at 4:00 p.m. mostly sunny like yesterday. mid level clouds sneaking into the bay area. not much. it is holding up well. good to moderate air quality. a weak disturbance is going to come through here tomorrow morning. clearly you can see that. the clouds coming in. maybe some low clouds and drizzle at the coast for the first part of the day on saturday. we'll get a stray north bay shower to be the case up in sonoma county. heading through the second half of saturday, that system races out of here and will drop temps a touch. we'll hold onto 60s and high pressure builds in quickly for your sunday. we've got warm sunshine on the way. you can hit the beach. i think places in monterey will be the warmest and santa cruz is looking good for sunday. 64 degrees today in gilroy. 63 in san jose. getting into the all important weekend. not too much of a difference between saturday and sunday. we'll have mostly cloudy skies to start the day saturday. sunday warming you up into the

mid 60s. and look at the climb. it is on for next week. up to 69 degrees by midsection of next week. we're transitioning closer to spring and it's going to feel like it around here across the bay area. let's check your drive. good morning, mike. >> good morning. folks in the south bay where we have no real issues as far as traffic flow goes. stopping traffic flow north 2830. overnight crews have had transition blocked over the last few weeks. the reroute is familiar. it is there picking up over the next hour. we're looking at no problems through fremont up in toward union city. hayward southbound side is where we look for some of the first slowing typical for nimitz in the morning. no problems including castro valley y. that's an easy drive. folks heading toward san mateo bridge unimpeded. let's get a look and see that traffic westbound a good steady flow. light right now heading over toward the san mateo side and no major issues across this span. heading down toward the bay bridge toward berkeley, west 80 heading down to the area smooth

flow under university over crossing. good spacing. 18 minutes from carquinez bridge down to the toll plaza. across the bridge into the city, a smooth flow as well. no problems on the span. golden gate north end we have crews that are clearing from that side. light volume of traffic throughout the north bay and approaching the city. easy flow here. no problems except for off-ramp at 3rd closed off 101. also we have that surface street issue east at bay shore road off 101 heading north of palo alto. that's in redwood city. we have chopper heading over there. deadly crash on surface streets that we'll talk about. back to you. >> thank you very much. it's 5:21. the coast guard is trying to figure out what caused a crane to topple over while working on the new eastern span of the bay bridge. the crane was lifting a piece of scaffolding yesterday afternoon when the scaffolding slipped causing it and the crane to fall. there were four people working on the crane at the time. none of them were hurt luckily. the opening of the bay bridge is still scheduled for labor day

looking off 101 north of redwood city where east bay shore boulevard is closed by the deadly accident we told you about. a car hit a fire hydrant there. visible from 101. our chopper is headed over to check things out. oakland on the other side of the bay. smooth drive for nimitz. picking up volume on a friday. it tends to get slow. back to you. it's 5:26 right now. parents out there keep in mind when you tell your child something, often times they listen, sometimes they don't. when they do listen, they are serious about it. a 10-year-old boy who got a visit from police. he was so upset about being sent to bed, he called 911. his mom was, like, hey, don't go to bed, call the police then. he called 911 and hung up before talking to anybody. police decided to stop by to be safe to check things out. his mom decided to turn the incidents into a learning experience. >> he wases go to leave without talking to my son. i said to him, can you please

pistorius bail hearing. "today in the bay's" marla tellez monitoring all of the details from south africa. what are you hearing so far? >> right now we're not hearing that decision for the last 50 minutes the magistrate has been going over the case verbally before the court. he's talking about the history of bail in the country of south africa right now. he's being very detailed. he's talked about the pros and cons of televising the oscar pistorius trial and gone over pistorius' account of the night before he shot and killed reeva steenkamp, his model girlfriend. the morning of her shooting death eight days ago on valentine's day. he stands by the story he accidentally shot her thinking she was a burglar. we hear from nbc news correspondents inside that courtroom via twitter. we're getting a sense of how pistorius is holding up. he's said to be sobbing silently. his eyes shut most of the time. his family is inside the courtroom as they have been the past few days.

a couple of steenkamp's relatives are there and pistorius' coach of nine years says he plans to get back to training pistorius immediately. >> i'm not the legal side of this. i'm ready. we can start training on monday if he's out on bail. >> he said he's going to start training on monday if he's out on bail. now according to the official twitter account of oscar pistorius, his first race of 2013 scheduled for early march. pistorius tweeting about it on february 11th, three days before the night that changed his life. he wrote "can't wait to burn it up." even if he does get out on bail, the question is will he want to run? his emotional state of mind is not very good to say the least. we're waiting for the decision to come down in that south african courtroom any minute now. when it does, we'll bring that to you right away. >> thank you very much, marla. happening right now, the manhunt is on this morning for the people responsible for the death of an oakland rapper and two

other people on the las vegas strip. quite the scene out there. las vegas police say people inside a black range rover opened fire on rapper kenneth cherry, aka rapper kenny clutch, while driving his maserati at 4:30 yesterday morning. he slammed into a cab. that caused the cab to explode. that cab driver and a passenger in the cab were also killed. four others were hurt in the crash that totally shut down part of las vegas boulevard. cherry's father spoke with "today in the bay" and bob redell is live in oakland right now with that part of the story. what's the latest? >> reporter: good morning to you, jon. kenneth cherry, sr., who lives here in oakland tells us that yesterday morning he received a horrifying phone call on the other end of that line his son's girlfriend calling to let him know that his first born rapper kenny clutch had been murdered on the vegas strip. >> when i talk about my son, that was the sweetest young man i ever met in my life.

>> reporter: a heartbroken father now having to bury his 27-year-old son and help look after his three grandchildren including a 2-month-old baby girl. cherry, sr., tell us his son was a bright kid especially when it came to math. his son attended several catholic schools in the east bay including st. mary's in albany. he attended chico state but decided to move to vegas to pursue his rapping career. he shows off his maserati an raps about women and guns. turns out the rapper was driving down the strip in that maserati yesterday morning when someone in black range rover shot and killed him injuring his passenger. the maserati then slammed into a taxi cab causing it to explode into flames killing its driver and passenger. police in nevada and neighboring states are still looking for that black range rover. incidentally, this incident

happened about a block away from another rapper where another rapper was shot and killed many years ago. reporting live here in oakland, bob redell, "today in the bay." it is 5:34 right now. dozens of city college students of san francisco are camped out right now this morning trying to get the chancellor's attention. live pictures right now where they are holding that sit in on the main campus. they want the chancellor to meet with them to talk about school plans to avoid closure. the college is fighting to keep accreditation after the school was found to have an excessive number of campuses and high n nonstructural cost. they say the school is being strong armed into making cuts. >> we want our accreditation but we don't want to be threatened to do it by a for-profit organization. we are a public school. not a private school. >> for the record, if the

first, let's check your drive. good morning, mike. >> for the most part freeways typical friday morning. i want to call your attention to 101. this is palo alto just south of the dumbarton bridge. you see palo alto and menlo park. this is just off seaport boulevard off-ramp. east bay shore boulevard. most folks not heard of it because it's off of the freeway and you don't need to go there unless you use those businesses. chopper is overhead. they have a scene of that deadly crash. sounds like overnight early about 2:15, 2:30 a car crashed into a fire hydrant there just off the off-ramp. you see that just on the other side of the bushes and so flashing lights are visible as more crews do arrive on scene if they have to come there it may be a distraction off 101 at the scene currently closed but seaport boulevard itself is open and you can take it over toward that shopping area and the other businesses just off 101. that's the east side of 101. look at the east bay looking at oakland where traffic volume

another body part. arturo santiago has the latest details of her arrest and what happens later today. >> reporter: 47-year-old anna ayala and her son are scheduled to be arraigned here at the hall of justice. back in 2005, ayala lied about the finger in the chili and did so with vivid descriptions talking about crunchiness of the finger. this time her son shot himself in the ankle but told police two men shot him for no reason. reyes has a burglary conviction and is not allowed to have a gun. his mom backed up his story and described two men. those two men in vivid detail. she said that one was wearing a black oakland a's cap and air jordan issues. the other was a big man with goatee and large ears. after an investigation and more questioning by detectives, their story fell apart and they were arrested and are now in custody.

"today in the bay's" tracie potts is live on capitol hill now with the latest on this one. tracie, good morning. >> good morning, jon. 50 planes of boeing have been grounded over a month now. boeing telling faa we think we have a fix. the problem was the ion battery that caught on fire here in the u.s. now they have a ten-point plan to present to the government. we're told they want to encase it, the battery, in a fire resistant box and move it away from other parts of the plane and improve ventilation to try to prevent this from happening again. boeing has a reason for wanting to get those planes back in the air. it's costing them $200 million a

the united states. in one case with a minor leaguer, italy. this is such a unique opportunity to not only break away from spring training and also represent your country, but also be on a different kind of world stage that ends up coming to san francisco. we'll explain that in a second. first, look at just how important this world baseball classic is to some of these giants players. spring training in scottsdale goes beyond the cactus league games as opening rounds of the world baseball classic begin just over a week from now. the semifinals and finals will be held at at&t park in the middle of march. ten players total in the giants organization representsing their various home nations teams. >> it would be nice to win the thing since the u.s. hasn't won it yet. it would be very cool to be a part of the first u.s. team to win the tournament. i'm excited about it. >> reporter: the giants outfielder is taking part with the puerto rican national team.

after two separate attacks on a popular trail near the south san francisco b.a.r.t. station. the attacks happened just hours apart on the centennial way trail wednesday night. in both cases the women were walking alone when they were approached by a man asking their name. when they refused to give it, the suspect then chased the women for a short distance. in one attack the man grabbed the victim but she managed to fight him off. police say it is possible the same man is responsible for both attacks but they say the women's description of the man differed. a gun buyback event. sponsored by two bay area fathers. protect our children has raised more than $30,000 for tomorrow's event which will trade cash for firearms. no questions asked. the organization's founder roger lee and coordinator james cook have children in palo alto schools and they say they were deeply affected by the mass shooting in newtown,

"today in the bay's" marla tellez is listening very closely for that verdict. she's live in the newsroom right now with the details. what's the latest? >> what's key is most recently the magistrate said he does not feel the prosecution has met the threshold for charging pistorius with premeditated murder essentially saying the state's case is weak and in doing so, he listed a few examples. he mentioned the debacle with the lead investigator who was removed from the case just yesterday. he's facing attempted murder charges in his own right for something that happened in 2011. he also mentioned the blunder with the testosterone that the lead investigator said was found in pistorius' bedroom has not been determined that's testosterone. he says as far as he's concerned, the prosecution presented circumstantial evidence and that's not enough for premeditated murder charge. he's gone through the grounds of bail. will pistorius
